Back a Boiler-ISA Fund Commitment to Privacy

Back a Boiler – ISA family of funds, which includes Back a Boiler – ISA Fund, LLC; Back a Boiler – ISA Fund II, LLC; Pave the Way – ISA Fund, LLC; and Purdue Research Foundation (collectively referred to in this policy as “Back a Boiler”) is committed to maintaining your confidence and trust, and accordingly maintains the following Privacy Policy to protect the personal information you provide. To make this notice easy to find, we make it available on our homepage.

Collection of Information

Personal Information

Personal information is information that identifies an individual or relates to an identifiable individual. Personal information may include, but is not limited to, your first and last name, physical address, Social Security number, date of birth, and checking account information. Back a Boiler does not request personal information through the Back a Boiler homepage. Back a Boiler will only collect your personal information if you provide it voluntarily, such as through telephone, e-mail, written, chat or other communications channels. Information submitted in connection with an application may include information such as name, address, Social Security number and phone number.

If you enter into an Income Share Agreement (referred to as an “ISA”) through the Back a Boiler program, the personal information you submit with your application, as well as all other information contained in your ISA file, will be shared with our servicer (currently Launch Servicing) as permitted by law for the purpose of collecting payments and otherwise servicing your ISA. Additional information may also be collected by our servicer in accordance with its privacy policy during the term of the ISA. This information is shared in accordance with and under the terms of applicable law and the servicer’s privacy policy.

Nonpersonal, Behavioral Information

Through the Back a Boiler web site, including the comparison tool, Back a Boiler may collect non-personal, behavioral information such as your internet domain and IP address, browser type, type of operating system, the date and time you visit the web site and the internal and third party links you click on while using the site, the address of the web site through which you linked to the Back a Boiler web site, information you enter into the comparison tool, as well as other information that is not considered personal information.

Non-personal, behavioral information may be collected through the use of the following technologies:

Cookies: A cookie is a small piece of computer code that enables web servers to identify users by storing information directly on the device you are using. Cookies do not store any information that you have provided to our site. They are simply identifiers. You have the ability to delete cookie files from your hard drive at any time or avoid cookies by configuring your browser to reject them or to notify you when a cookie is being placed on your hard drive. If you choose to disable cookies, some components of the web site may not function properly.

Flash Objects: Flash Objects, sometimes called local shared objects, are data files that can be created on your computer by the sites you visit. Shared objects can’t do anything with the data on your computer or access or remember information stored on your computer unless you willingly provide such information. Deleting cookies does not delete flash objects, but you can control and disable flash objects through the Adobe interface. If you choose to disable flash objects, some components of the web site may not function properly.

Pixel Tags, Web Beacons and clear GIFs: These types of technologies use invisible tags placed on certain pages of the web site, but not on your computer. They also enable web sites to read and place cookies.

Third Party Widgets: We may allow certain widgets (e.g., social share buttons) on our web site to enable users to easily share information on social media platforms. Third parties that own these widgets may have access to information about your browsing on our web site. You should review the privacy policies of these third parties to determine how they collect and treat such information.

Google Analytics: We may use Google Analytics to collect non-personal information about your use of the web site. Please refer to the Google Privacy Policy available at https://www.google.com/policies/privacy/ for more information on the collection and use of this information.

Use of Information

Back a Boiler obtains personal information contained in ISA files from our servicer for record-keeping purposes in relation to and for the purpose of fulfilling its obligations with respect to managing its Back a Boiler ISA transactions and program.

We may use your personal information to: (i) communicate with you about the ISA transactions and program or important changes to our web site or ISA or (ii) provide you with customer service. We may use your personal information for other purposes, but only with your consent.

You may be asked to provide personal information for a specific purpose. We will only use the information that you provide for the purpose for which you provided it to us.

We use the non-personal behavioral information that we collect to personalize your experience on our web site, to maintain and improve our web site, to write or publish reports or other documents that include aggregate data, for fraud detection and prevention, for security purposes and for other business purposes consistent with applicable laws, such as offering products or services, research, marketing or analyzing market trends.

Back a Boiler or Purdue Research Foundation may from time to time compile information from ISA files and transactions into aggregated and de-identified data sets that do not identify individual ISA recipients. These aggregated and de-identified data sets may be used for business purposes consistent with applicable laws, such as offering products or services, research, marketing or analyzing market trends.

Information Sharing

Back a Boiler is not responsible for the information collection and storage practices of its third party contractors, but all third party contractors are required to comply with applicable law in connection with such activities. Back a Boiler receives information submitted to our servicer in accordance with applicable law and under the terms of their respective privacy policies.

Back a Boiler does not share your personal information with nonaffiliated third parties, except as permitted by law.  Back a Boiler may share your personal information with its affiliates, as permitted by law. Back a Boiler does not sell your personal information. We require companies, such as our servicer, that assist us in delivering and managing the Back a Boiler ISA program to protect your personal information in accordance with applicable law.

The fact that you have entered into an ISA under the Back a Boiler ISA program will be communicated to the Purdue University Division of Financial Aid. The privacy of financial aid records maintained by Purdue University is protected by the Family Educational Rights and Privacy Act and regulations (FERPA).

Information may also be shared with unaffiliated third parties to comply with a legal requirement, such as a law, regulation, court order, subpoena, search warrant or other legal proceeding, including for collections purposes with respect to delinquent payments under an ISA, or if we believe it is necessary in order to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.

We may also share information in the event of a merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets or if we undergo bankruptcy or liquidation.

Finally, we may request your permission to share personal information for a specific purpose. We will notify you and request consent before you provide the personal information or before the personal information you have already provided is shared for such purpose.

Security

Back a Boiler has implemented a number of industry standard security features throughout the Back a Boiler site to prevent the unauthorized release of or access to personal information. Please be advised, however, that although we have endeavored to create a secure and reliable site for you, the confidentiality of any communication or material transmitted to or from Back a Boiler or its affiliates via the web site or e-mail cannot be guaranteed. When disclosing any personal information, you should remain mindful of the fact that it is potentially accessible to the public, and consequently, can be collected and used by others without your consent. Back a Boiler has no responsibility or liability for the security of information transmitted via the Internet.

Children's Privacy

Back a Boiler does not knowingly collect personal information from individuals under the age of thirteen (13). If we become aware that we have unknowingly collected such information, we will take all reasonable measures to delete that information from our system as soon as possible.

Browser Do Not Track

Our web site is not currently configured to respond to Do Not Track signals.

External Websites

To the extent hyperlinks or banner advertisements incorporating hyperlinks are utilized to access third party sites, you should be aware that these third party web sites are not controlled by Back a Boiler or Purdue Research Foundation and, therefore, are not subject to this Privacy Policy. You should check the privacy policies of these individual sites to see how your personal information will be utilized by the operators of those third party web sites.

Your Consent

By using our web site, you consent to the collection and use of this information by Back a Boiler and Purdue Research Foundation. Back a Boiler may modify this Privacy Policy from time to time.
