For purposes of this Section, an “Early Ending” occurs if
The Sponsored International Scholar/Staff Member, Host or Host Unit
Determines that the activities of the Sponsored International Scholar/Staff Member
Must end on a date that is 2 or more months before the end of the University-sponsored immigration status, namely:
The Box 3 end date on a J-1 scholar’s current DS-2019, or
The Validity End Date of the most current Form I-797 Approval Notice for H-1B, O-1, TN or E-3 workers, or
The Authorized Stay End Date listed on the most current I-94 Record for certain border-processed TN or E-3 workers
For reasons other than the early completion of all program objectives and goals, and regardless of whether the appointment or employment ends through termination or resignation.
Early Endings might in limited circustances be necessary, but are generally reason for concern.
The presence of a Sponsored International Scholar/Staff Member at the University involves complex combinations of laws, rules, and policies governing immigration, international, employment, export control and other matters. Early Endings complicates the clean termination of mutual responsibilities under these laws, rules and policies for both the International Scholar and University.
The fact that an international person is temporary does not mean they are disposable, without regard for their investment in the opportunity at Purdue.Considerations of fairness require Early Endings to be evaluated.
Responsibilities of the Host and Host Unit in situations involving Early Endings
If a Sponsored International Scholar, Host and/or Host Unit foresees a potential for Early Ending, each must promptly notify International Scholar Services.
If the justification for a potential, future Early Ending includes concerns about the ability of the Sponsored International Scholar/Staff Member to succeed, the Host and/or Host Unit must seek guidance from the Host Unit’s assigned Human Resources Business Partner (https://www.purdue.edu/hr/aboutus/employees.php) about
Effectively discussing their concerns with the Sponsored International Scholar/Staff Member to help them understand and address the concerns, and
Possible Host/Host Unit steps toward meaningful assistance for the Sponsored International Scholar/Staff Member, to encourage or promote improved performance.
If a Host/Host Unit chooses not to fulfill the responsibilities listed above in subsection c), and an Early Ending is attempted, responsibility for the Sponsored International Scholar/Staff Member moves to the Unit Head.
The Unit Head must offer to the Sponsored International Scholar/Staff Member professional activities or tasks appropriate for the sponsored visa status
If the Sponsored International Scholar/Staff Member agrees to the re-assignment, the professional activities must be made available for not less than 3 months, so that the International Scholar can either choose to look for another opportunity in the USA, or wind up their presence in the USA.
This responsibility ends when either
the International Scholar transfers to another US university/institution/organization, or else departs the USA, or
three months from the Early Ending date, whichever comes first.
If the Unit Head permits the Early Ending without the support explained above, International Scholar Services may consider that when evaluating future requests by the Host, Unit Head, and/or Unit to host any Sponsored International Scholar/Staff Member, including faculty, staff, postdocs and scholars.
Hosts and/or Host Units may not coerce Sponsored International Scholars/Staff Members to agree to Early Ending using the issuance/withholding of reference letters. If International Scholar Services learns that a Host/Host Unit has tried to coerce a Sponsored International Scholar/Staff Member in this way, International Scholar Services may consider that when evaluating future requests by the Host, Unit Head, and/or Unit to host any Sponsored International Scholar/Staff Member, including faculty, staff, postdocs and scholars.
