IX. Interruptions of Visa Authorizations

  1. International Scholars/Staff Members sometimes experience temporary interruptions to their permission to engage in work or research in the USA.
  2. Lawful Presence Usually Contines. While the specifics will vary depending on the immigration status and circumstances, an interruption in permission to engage in work or research activities may not impact the permission of the individual to physically remain in the USA. In other words, it is often possible for a Non-US Person to remain lawfully in the USA even if temporarily not permitted to engage in their chosen activities.
  3. Employment Must Be Terminated. If the international person is an employee, then US law and Purdue policy requires termination of University employment until the individual again holds immigration authorization for employment. Note that, as stated above in our discussion of Visiting Scholars, movement of an International Employee to a Visiting Scholar appointment during a temporary interruption to employment authorization is generally not permitted.   4. International Visiting Scholars. Termination of International Visiting Scholar appointments may be required during temporary interruptions to work/research permissions, depending on the specific facts of the situation.
